"On the Other Side," a legal assistance and support group for immigrants, has filed a lawsuit regarding immigration and asylum matters against the federal government of the United States in conjunction with other organizations.
Since President Trump took office, it has been impossible to apply for asylum at the border, and this, which immigration attorneys themselves consider a "violation" of existing laws in the U.S., is one of the issues addressed in the lawsuit.
In recent statements to journalist Mario J. Pentón, attorney Jesús Novo specified that this group already filed another lawsuit during Trump's previous term, in 2019.
On that occasion, they protested for something very similar, in defense of individuals who had been ordered for deportation without the chance to defend their asylum cases.
Novo specified that they then won the lawsuit and that those cases had to be reopened.
The current demand is more or less the same, stating that individuals at the southern border are not being given the opportunity to present asylum cases, which is a violation of U.S. law, as American laws permit those who arrive at the border to have the ability to present "a credible fear."
"It doesn't mean that those asylum cases will be won, but they should be allowed to defend them in court," argued the lawyer.
Pentón emphasized that at this time, no one is allowed to reach the border and request asylum, and it is very important that everyone knows this.
The journalist emphasized that the coyotes are deceiving many people crossing the border and that they are being apprehended and deported, along with facing penalties.
Another aspect of the demand: CBP One appointments that were suspended
The lawsuit also reveals that the suspension of all previously scheduled CBP One appointments, which were canceled outright at the time Trump took office, was illegal.
“These individuals had their appointments and had done so in an orderly manner; however, upon taking office, the president canceled the appointments and no one else can enter,” noted Novo.
The lawyer concluded that the lawsuit is already underway and will be decided in the courts.
Frequently Asked Questions about the Immigration and Asylum Lawsuit Against the U.S. Government.
Why has a new lawsuit been filed against the Trump administration?
The lawsuit has been filed because the Trump administration does not allow individuals to apply for asylum at the southern border of the U.S. This is considered a violation of U.S. laws that permit individuals arriving at the border to present a "credible fear" as part of their asylum application.
What happened to the CBP One appointments under the Trump administration?
The CBP One appointments were illegally suspended by the Trump administration upon taking office. This left many individuals with scheduled appointments in limbo, as their appointments were canceled without further explanation, preventing them from seeking asylum or entering the country legally.
How does the revocation of work permits under CBP One affect Cuban migrants?
The revocation of work permits under CBP One leaves Cuban migrants without legal means to sustain themselves in the U.S. This measure by the Trump administration forces those affected to leave the country or face potential legal penalties. Work permits were a way to remain in the country while applying for political asylum.
What can be expected from the future of Trump's immigration policies?
Trump's immigration policies are expected to be more restrictive and aggressive. His administration has begun to revoke programs such as humanitarian parole and the CBP One application, and has implemented measures to strengthen border control and limit immigration through policies like "Remain in Mexico."
